Health Law, COVID and Schools

This is Part 1 of a webinar series on COVID and the law. The focus of these webinars will be on health law and policy and the impact of the pandemic response on communities which have sought enhanced protections.

The panel discussion in Part 1 will focus on health law and policy with a focus on schools. We will be joined by leading Constitutional Lawyer, and former University of Toronto and NYU Professor and former Dean of Berkeley School of Law, Sujit Choudhry who will discuss governmental Charter obligations as they relate to the current public health situation.

Dr. Lorian Hardcastle, Associate Professor, Faculty of Law, University of Calgary, will discuss the concepts of governmental immunity and the emergency powers of the Provincial Health Officer (PHO), and any implications to school boards and school trustees.

Lawrence Wong, counsel in the matter of Trest v. BC (Minister of Health), 2020 BCSC 1524 will discuss some of the legal issues that arose in that case, involving safety measures adopted by schools in BC. He will be joined by Dr. David Fisman, one of Canada’s leading epidemiologists, Professor at the Dalla Lana School of Public Health at the University of Toronto and a member of Ontario’s COVID-19 Science Advisory Table who acted as an expert witness in the case.

Dr. Deepti Gurdasani, epidemiologist and senior lecturer with Queen Mary University of London, and a member of the Independent SAGE will discuss with Dr. David Fisman the scientific context of the pandemic, including modes of transmission and safety measures applicable to the school context .
